These Terms of Use set out the conditions for using the website https://latam.fcaeglobal.com (the “LATAM Website”). The LATAM Website is operated on behalf of Fredericton Christian Academy (“FCA”, “we”, “us”, “our”), a private K to 12 school located in Fredericton, New Brunswick, Canada.
The LATAM Website is an informational platform that supports FCA’s communication, marketing and pre admissions outreach in Latin America.
By accessing or using the LATAM Website, you agree to be bound by these Terms of Use. If you do not agree, you must not use the LATAM Website.
Nothing in these Terms limits any rights you may have under applicable law, including Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
For the purposes of these Terms:
“FCA” or “School” means Fredericton Christian Academy in Fredericton, New Brunswick, Canada.
“LATAM Operations” means FCA’s Latin America regional team and any FCA staff or contractors who provide marketing, communications and pre admissions support for Latin America.
“User”, “you” or “your” means any visitor to the LATAM Website, including parents, students, agencies and other representatives.
“Programs” means FCA’s academic and non academic offerings, including K to 12, High School, Mini High School, Summer Programs and other educational programs described in FCA’s official materials.
2.1 Informational purpose only
The LATAM Website is provided for informational and promotional purposes only. It is intended to help prospective students, families and partner agencies understand FCA Programs and life at the School.
The LATAM Website does not:
create any contract between you and FCA,
create any contract between you and LATAM Operations,
create any partnership, joint venture, employment or agency relationship,
provide legal, immigration, tax or financial advice.
2.2 No educational services provided by LATAM Operations
All educational services are provided exclusively by FCA in Canada. LATAM Operations:
do not provide educational services,
do not collect or receive tuition or homestay payments on their own behalf,
do not issue invoices or financial statements,
do not make academic decisions,
do not guarantee admission, visa approval, homestay placement or scholarships.
2.3 Relationship with FCA official documents
For students who enrol at FCA, rights and obligations are governed by:
the Letter of Acceptance (LOA),
the enrolment and financial agreement signed with FCA,
the FCA Family Handbook,
the FCA International Student Handbook,
and any other official FCA policies provided by the School.
If there is any conflict or inconsistency between information on the LATAM Website and these official FCA documents, the official FCA documents always prevail.
2.4 Relationship with agencies and partner schools
Where an educational agency or partner school has signed an FCA LATAM Agency Agreement or similar contract:
that agreement governs the commercial and operational relationship between FCA and the agency or partner,
LATAM Operations are identified only as liaison and support for marketing and communication,
agencies are solely responsible for how they present FCA information to their own students and families.
Use of the LATAM Website by an agency or partner does not modify or expand FCA’s or LATAM Operations’ responsibilities beyond what is set out in the signed agreement.
By using the LATAM Website, you represent that:
you have reached the age of majority in your jurisdiction, or
you are a parent or legal guardian using the site on behalf of a minor, or
you are an authorized representative of an agency or educational institution.
If you do not meet these conditions or do not agree with these Terms, you must not use the LATAM Website.
4.1 Ownership
All content on the LATAM Website, including text, images, videos, logos, graphics, downloads and layout, is owned by FCA or its licensors and is protected by Canadian and international intellectual property laws.
4.2 Permitted use
You may access, view and print pages from the LATAM Website for personal, non commercial use in connection with evaluating FCA Programs. You must keep all copyright and proprietary notices intact.
4.3 Prohibited use
You must not:
reproduce, copy, modify, publish, distribute, sell or exploit any content from the LATAM Website for commercial purposes without FCA’s prior written consent,
use the LATAM Website in any manner that could damage, disable, overburden or impair our servers or networks,
attempt to gain unauthorized access to the LATAM Website, FCA systems or user accounts,
use any automated system such as robots or spiders to access the LATAM Website in a way that sends more requests than a human user could reasonably produce.
When using the LATAM Website, you agree to:
provide accurate, current and complete information in all forms and communications,
update your contact information as necessary so we can communicate with you,
not submit content that is unlawful, harmful, offensive, defamatory, harassing, discriminatory, obscene or otherwise inappropriate,
not interfere with or attempt to interfere with the security or proper functioning of the LATAM Website.
You are responsible for ensuring that your use of the LATAM Website complies with all laws that apply in your jurisdiction.
6.1 Non binding information
Program descriptions, tuition estimates, homestay overviews, activity schedules, scholarship references and other information on the LATAM Website are provided for general reference only. They:
do not constitute a formal offer,
may not reflect the most up to date details,
are subject to change at any time without notice.
6.2 Admissions
Submitting an enquiry, form or application through the LATAM Website does not guarantee admission to any Program. All admissions decisions are made solely by FCA, in accordance with its policies and applicable law.
6.3 Fees, refunds and cancellations
All binding financial terms, including tuition, homestay fees, refund conditions and cancellation policies, are contained in:
the LOA and enrolment and financial agreement issued by FCA, and
the FCA International Student Handbook and other official FCA policies.
In general, and without limiting the full policy:
refunds are limited and usually apply only in specific cases such as official study permit refusal or death in the immediate family,
voluntary withdrawal, disciplinary expulsion or change of personal plans normally does not result in a refund,
administrative and application fees are non refundable.
If there is any conflict between a summary on this website and FCA’s official refund policy, the official policy prevails.
6.4 Third party services and immigration
You are solely responsible for:
obtaining visas and permits,
working with any immigration consultant or lawyer,
arranging flights, insurance and other travel services.
FCA and LATAM Operations may provide general guidance but do not provide legal or immigration advice and are not responsible for the work, advice or omissions of any third party.
FCA works with agencies and partner institutions in various countries. While FCA strives to work only with reputable partners:
FCA and LATAM Operations are not responsible for any promise, guarantee, marketing statement or commitment made to you by a third party agency or school that goes beyond FCA’s official written documents,
if information provided by an agency conflicts with FCA’s official documents, the FCA documents prevail,
any dispute between you and an agency is a matter between you and that agency.
Your use of agencies or other intermediaries is at your own risk.
The LATAM Website may contain links to third party websites or social media platforms. These links are provided for convenience only.
FCA does not control and is not responsible for:
the content, accuracy or security of third party websites,
the privacy or data practices of third parties.
Your use of third party websites is governed by their own terms and privacy policies.
Personal information collected through the LATAM Website is handled in accordance with FCA’s Privacy Policy for the LATAM Website, which is available on a separate page.
Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) applies to FCA’s handling of personal information.
By using the LATAM Website, you consent to the use of cookies and similar technologies as described in the Privacy Policy.
Information on the LATAM Website is provided on an “as is” and “as available” basis. Without limiting anything in these Terms, you acknowledge that FCA and LATAM Operations:
do not guarantee admission to any Program,
do not guarantee the issuance of any visa or study permit,
do not guarantee the granting of scholarships or financial aid,
do not guarantee admission to any university or college,
do not provide legal, immigration, tax or investment advice.
You should obtain your own professional advice where appropriate.
To the maximum extent permitted by law, FCA and LATAM Operations disclaim all warranties and conditions of any kind, whether express, implied or statutory, including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose, noninfringement, accuracy and availability.
FCA does not warrant that the LATAM Website will be uninterrupted, secure or error free, or that any defects will be corrected.
To the maximum extent permitted by applicable law:
FCA and LATAM Operations, and their directors, officers, employees and representatives, are not liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising from or relating to your use of, or inability to use, the LATAM Website or its content, even if they have been advised of the possibility of such damages,
FCA’s total aggregate liability arising from or related to the LATAM Website and these Terms is limited to one hundred Canadian dollars (CAD 100).
Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities. In such cases, the above limitations apply to the fullest extent permitted by the laws of that jurisdiction.
You agree to indemnify and hold harmless FCA, LATAM Operations, and their directors, officers, employees and representatives from and against any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or in connection with:
your use of the LATAM Website,
your breach of these Terms,
your violation of any law or third party right.
FCA may modify or discontinue any part of the LATAM Website at any time without notice.
FCA may update these Terms from time to time. When changes are made, the “Last updated” date will be revised at the top of this page. Your continued use of the LATAM Website after any changes are posted means that you accept the updated Terms.
These Terms and any dispute arising from or relating to the LATAM Website are governed by:
the laws of the Province of New Brunswick, and
the federal laws of Canada that apply in that province,
without giving effect to any conflict of laws rules.
You agree to submit to the exclusive jurisdiction of the courts of New Brunswick, Canada, in respect of any dispute related to these Terms or the LATAM Website, subject to any mandatory rights you may have under the laws of your country of residence.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the extent permitted by law and the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and FCA regarding your use of the LATAM Website.
In the event of any translation of these Terms into another language, the English version will control and prevail in case of any inconsistency.
